外商投资开发房地产的基本程序
外商投资房地产的项目审批,对外履约等,由广州市对外经济贸易委员会(市外经贸委)负责;房地产开发项目的生产、经营、管理等由广州市建设委员会(市建委)负责。
一、外商取得土地使用权,投资开发房地产的途径
(一)竞投方式
通过参加政府土地主管部门公开主持的土地使用权的招标或拍卖,以竞投方式直接取得开发用地进行开发经营。
(二)合作方式
由外商出资、广州市内的开发公司出地和
资金,组成合作项目公司从事房地产开发经营。这类项目由合作双方先报经市建委初审同意,并再向市外经贸委申请办理立项和合同审批手续。合作项目经市外经贸委批准后,合作双方始得向市房地局申请办理变更登记,将该土地使用权转入合作公司,外商通过合作公司按合同规定比例持有该土地使用权并从事房地产开发经营。
二、投资项目审批
(一)投资方式
目前主要是合作方式。政府鼓励国内开发公司以土地使用权作为投资或合作条件与外商组成开发企业。合作企业有利于发挥中方原有用地的地利和人缘条件,共担风险。合作房地产企业需向政府建设行政主管部门办理资质审查,方可获得房地产开
