立契约书人x x x(以下简称甲方),x x x(以下简称乙方),兹因合作兴建房屋事宜,经双方协议,同意订定各条款如下:
    第一条 甲方所有坐落x x x x地号土地一笔,如附图所示,约x x平方米。愿提供与乙方合作兴建房屋。
    第二条 本约甲方所提供的土地双方协议同意兴建四层钢筋混凝土造和集合住宅,除依法应设置的公私道路用地外,其余可建土地,乙方应依法合理充分利用。
    第三条 本约双方合作兴建房屋,其土地规划,建筑设计,请领建造执照,营造施工及有关的风险等,均由乙方负责处理并负完全责任,其各类费用亦由乙方负担,概与甲方无涉。乙方营造施工过程中,甲方得随时亲自派员监督。
    第四条 本约甲乙双方按附图所示的拟建房屋为准,采立体分屋方式,由甲方取得百分之x x ,乙方取得百分之x x 。若双方分取的房屋户数未能整数时,其间的差额,可经双方的同意,由取得之一方按协议价格以现金补偿对方。
    第五条 本约有关建造设计文件图说应征求甲方同意,并按前条双方分配的位置,标明于图说上,各自具名或指定第三人为起造人,由乙方负责提出申请建造执照。
    第六条 本约兴建房屋事宜,均依现行建筑法规办理,若法规变更而受限制时,则依变更后的法规办理。
    第七条 凡畸零地及水利地的合并承买等事宜,均由甲方备齐所需证件并由乙方负责办理。惟
