《案例1》某建筑工程采用邀请招标方式。业主在招标文件中要求： (1)项目在21个月内完成， (2)采用固定总价合同， (3)无调价条款。承包商投标报价364000美元，工期24个月。在投标书中承包商使用保留条款，要求取消固定价格条款，采用浮动价格。但业主在未同承包商谈判的情况下发出中标函，同时指出：（1） 经审核发现投标书中有计算错误，共多算了7730美元。业主要求在合同总价中减去这个差额，将报价改为356270(即364000－7730)美元。（2） 同意24个月工期。（3） 坚持采用固定价格。承包商答复为： (1)如业主坚持固定价格条款，则承包商在原报价的基础上再增加75000美元。 (2)既然为固定总价合同，则总价优先，计算错误7730美元不应从总价中减去。则合同总价应为439000(即364000＋75000)美元。在工程中由于工程变更，使合同工程量又增加了70863美元。工程最终在24个月内完成。最终结算，业主坚持按照改正后的总价356270美元并加上的工程量增加的部分结算，即最终合同总价为427133美元。而承包商坚持总结算价款为509863(即364000＋75000＋70863)美元。最终经中间人调解，业主接受承包商的要求。案例分析： (1)对承包商保留条款，业主可以在招标文件，或合同条件中规
