《案例1》某建筑工程采用邀请招标方式。业主在招标文件中要求: (1)项目在21个月内完成, (2)采用固定总价合同, (3)无调价条款。承包商投标报价364000美元,工期24个月。在投标书中承包商使用保留条款,要求取消固定价格条款,采用浮动价格。但业主在未同承包商谈判的情况下发出中标函,同时指出:(1) 经审核发现投标书中有计算错误,共多算了7730美元。业主要求在合同总价中减去这个差额,将报价改为356270(即364000-7730)美元。(2) 同意24个月工期。(3) 坚持采用固定价格。承包商答复为: (1)如业主坚持固定价格条款,则承包商在原报价的基础上再增加75000美元。 (2)既然为固定总价合同,则总价优先,计算错误7730美元不应从总价中减去。则合同总价应为439000(即364000+75000)美元。在工程中由于工程变更,使合同工程量又增加了70863美元。工程最终在24个月内完成。最终结算,业主坚持按照改正后的总价356270美元并加上的工程量增加的部分结算,即最终合同总价为427133美元。而承包商坚持总结算价款为509863(即364000+75000+70863)美元。最终经中间人调解,业主接受承包商的要求。案例分析: (1)对承包商保留条款,业主可以在招标文件,或合同条件中规
